These general terms of sale apply between the Association Moncanyon Guadeloupe (hereafter “Moncanyon”) and anyone booking an activity. They may be amended by the Association Moncanyon Guadeloupe. Booking an activity implies that all adult participants (or the legal guardian of minors) have read these terms and the association’s internal rules, and fully accept them. The French version prevails in case of dispute.

Services

Supervision and teaching of sports activities offered by the Association Moncanyon Guadeloupe are provided by state-certified guides.

Services may also be provided by guides who are self-employed. Self-employed guides working with Moncanyon meet all the legal obligations of their profession. Only the self-employed guide is responsible for the service, in line with the prerogatives of their sports teaching qualification.

Cancellation by Moncanyon

The decision to cancel a trip because of weather-related danger rests with the guide(s) or instructor(s) in charge of the group’s supervision and safety, and with them alone. This decision is final. A trip can only be cancelled for weather reasons if conditions create a risk for the activity; it is then postponed, or cancelled and refunded.

Moncanyon reserves the right to cancel a trip if the minimum of four participants is not reached (private trips excepted).

If Moncanyon cancels, any amount already paid is refunded in full.

For any booking with a total of €1,500 or more that has to be cancelled because of bad weather, Moncanyon refunds the deposit minus 10% of the total amount, corresponding to the costs incurred in organising the service.

Booking and payment

Bookings must be made by an adult. They are usually made online on our website, and in some cases by phone, e-mail, post or in person.

The customer receives by e-mail or phone the information needed for the trip (date, time and meeting point, equipment to bring, amounts due).

When booking, a deposit equal to the price of one place is paid online by card (secure payment by Stripe). The balance is paid on site, on the day of the trip, in cash or by card.

Cancellation or changes by the customer

These conditions apply whatever the number of participants:

Any partial or total cancellation by the customer due to force majeure gives rise to a refund of the deposit and no payment for the service. The customer must provide supporting evidence (medical certificate or official document).

Any change by the customer to essential elements (programme, date, destination, number of participants…) is treated as a cancellation and incurs the same charges. The absence of one or more participants is subject to the same conditions as a cancellation.

If the trip is interrupted (giving up during the trip because of tiredness, lack of the required ability, failure to follow instructions, endangering oneself or others, non-exhaustive list), the customer or participant is not entitled to any refund.

Prices

Prices are shown on our rates page. They are in euros and are not subject to VAT (Article 293 B and/or 261-4-4° b of the French General Tax Code).

Prices include supervision, the loan of activity equipment and the instructor’s professional liability insurance. They do not include transport to the meeting point and the activity site, any equipment hire (canyoning shoes, for example), personal expenses and, for full-day or multi-day activities, picnics, meals and accommodation.

Group rates apply to groups of minors supervised by an organisation: holiday centres, schools, youth homes, etc.

Insurance

The Association Moncanyon Guadeloupe holds professional liability insurance for its own activities. Other instructors working on behalf of Moncanyon are also insured for professional liability. These policies only cover customers if the instructor(s) are found liable.

Moncanyon cannot be held liable for activities booked with its partners.

Each participant should have personal accident insurance (often included in home, car or credit card insurance) and personal liability insurance.

Moncanyon also holds liability insurance for the resale of sports activities, covering the organisation, sale and resale of supervised activities before they are delivered by the self-employed instructors in the field.

General and health recommendations

All services offered by Moncanyon are outdoor sports and leisure activities considered “at risk”.

When booking, it is up to you to check the prerequisites and the required level. Although routes are adapted and personalised, make sure your physical condition is sufficient before committing. Do not overestimate yourself, and ask for information before booking.

If you book for a group, you agree to inform each participant of the content of the activities, the conditions of participation, the risk sheet and these terms of sale.

For all white-water activities, you do not need to be able to swim, but you must not be afraid of water.

Medical contraindications

Despite all the safety measures taken during our activities, in strict compliance with the rules and practices of the profession, we apply the precautionary principle to avoid endangering others.

Given the unpredictable nature of the activities (such as canyoning), the level of danger assessed from field experience, and the difficulty of assessing a participant’s level beforehand, you must report certain previous conditions or injuries, for example a sprained ankle or knee surgery, which could be weakened or even worsened by an injury.

To help us look after you and steer you to the most suitable activity, it is your responsibility to inform the instructor and the organiser, in particular in case of asthma, diabetes, ankle, shoulder or knee injuries, chronic ear infections and tendinitis.

As a general rule, our activities are not recommended for people with breathing or cardiovascular problems, prone to tetany attacks, or with epilepsy.

Minors

Except in special cases, and at the organiser’s discretion, minors under 13 who are not accompanied by an adult (legal guardian, father, mother, or adult brother or sister) are not accepted.

Minors aged 13 to 17 who are not accompanied are accepted with a signed parental authorisation and under certain conditions (sporting level, ability, medical contraindications…).

Holiday and leisure centre groups are limited to 8 young people per instructor, and each group is accompanied by a leader from the centre, in line with regulations.

Under no circumstances do instructors or individual customers transport a minor in their own vehicle. Families who allow unaccompanied children to take part therefore arrange their transport to the meeting point and the activity site car park.

Image rights

By taking part in one of our activities, you agree that your image may be used for promotional purposes on our printed and digital media (videos, photos, website, social networks), unless you object in writing by registered letter with acknowledgement of receipt, including a photo so that we can identify you.

Under the General Data Protection Regulation (GDPR) and French Law No. 78-17 of 6 January 1978, you have the right to access, correct and delete your information by writing to info@moncanyon.com.

Quality and environmental charter

To keep outdoor activities sustainable, we favour local routes and encourage car sharing. Ask when you book.

Disputes and consumer mediation

In the event of a dispute, the parties will try to settle it amicably: the customer sends a written complaint to info@moncanyon.com.

If no amicable agreement is reached, or if there is no reply within one month, the consumer may refer the matter free of charge to the competent mediator on the list drawn up by the French Commission for the evaluation and control of consumer mediation, under Article L.615-1 of the French Consumer Code.

Theft

The instructor accepts no liability for theft or loss of belongings left in your vehicles. This is very rare, but we advise you to bring only what you need for the activity: your swimsuit and your sports shoes.
